Article 1 - Object

These general conditions of sale apply exclusively to relations between the seller “Bionetal.com” and the entity (“The customer”) having placed the order on the Internet site(s) “Bionetal.com ". Any order implies unreserved acceptance by the customer of the general conditions of sale.

Article 2 - Price

Billing is established according to the prices set on the website, at the time of the order.

Article 3 – VAT

For customers located in France (excluding Overseas Territories), VAT, at the current rate, is added to the price excluding tax
For customers located in the French Overseas Territories: invoicing is excluding tax

For customers located in other countries of the European Union:
– individuals: VAT, at the rate in force in France, is added to the price excluding tax
– companies: invoicing is done excluding tax to the extent that the company communicates its intra-community VAT number.

For customers located outside the European Union, invoicing is excluding tax.

Article 4 – Delivery

The company is open Monday to Friday (excluding public holidays)

* These transport conditions only concern orders placed on the bionetal.com website. The order processing times indicated on the bionetal.com website are average times. Delivery times are given as an indication subject to acceptability of the order. Their non-compliance can in no way engage the liability of the Seller and nor give grounds for cancellation, compensation or refusal. If deadlines are exceeded by more than 30 working days, the Customer may cancel his order subject to informing the Seller in advance.
Whatever the delivery terms, our products travel at the risk of the buyer who must, where applicable, make all reservations at the time of receipt.
Consequently, in the event of any damage or deterioration occurring to the goods after shipment, the Seller cannot be held liable.
The Seller is released from his delivery obligation for all fortuitous events and force majeure.

Article 5 – How to place your order

You can place your order online on the website www.bionetal.com, using the payment methods described in Article 6

You can also, if you wish, place your order on plain paper or by sending an Order Form to the address below (see Article 14, at the bottom of this page), by bank transfer (see Article 6: Payment by bank transfer) or by enclosing your payment check payable to Hepro SARL.

Access reserved for professionals is subject to the registration of the User who must complete the online form online allowing him to obtain his customer code (username) and a password. This information is strictly personal. Any loss or omission must be reported to the Seller as soon as possible using the Contact form.
As a reminder, minors do not have the capacity to contract.

Article 6 – Payment

Unless otherwise agreed, orders will be shipped after payment. An outstanding amount may be granted to companies, after prior agreement.

Article 7 – Receipt of goods

Upon receipt of the goods, the customer must check, in the presence of the delivery person, the condition and number of packages delivered.

In case of doubt, he is required to refuse the package or accept the package, mentioning the appropriate reservations on the carrier's slip. The customer has 48 hours to notify the transport company by registered letter with acknowledgment of receipt.

Article 8 – Complaints – Back

Any complaints about apparent defects or non-conformity of the product delivered to the product ordered can only be received by registered letter with acknowledgment of receipt and within eight days after receipt of the goods.
The absence of a complaint within this period implies full and definitive acceptance of the products.
In the event of a regularly made and justified complaint, the goods will be exchanged identically, to the exclusion of any compensation of any kind whatsoever.
Any return of goods cannot be made without the prior agreement of the Seller, and in this case, the products must be complete and accompanied by all accessories, instructions and other documentation, in their original packaging and condition. The return must be made free of carriage, the delivery costs inherent to this return, except for apparent defects or non-compliance, being the responsibility of the sending Customer.

Article 9 - Responsibilities

The Seller cannot be held responsible for damage or accidents caused by the products it supplies as well as any anomalies resulting from their improper use or non-compliance with prudence or custom, whether during handling, storage or transport of products.
On the other hand, the Seller only has an obligation of means for all stages of access to the site, the ordering process, delivery or subsequent services. It cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a service interruption, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law. .

ARTICLE 10 – INTELLECTUEL PROPERTY RIGHTS

The transfer of ownership of the goods delivered to the customer will only take place after full payment of the price.

Article 11 – Labeling

Our products are labeled in accordance with the regulations in force for classification, packaging and labeling, as well as those in force for transport.
The Safety Data Sheets for classified products are available to the Customer upon simple request.

Article 12 – Individuals’ right of withdrawal

The individual customer has a withdrawal period of 7 clear days from the delivery of his order which will be reimbursed against return of the products delivered. The right of withdrawal cannot be exercised unless the parties have agreed otherwise, for consumables, when they have been unsealed by the consumer. Article 15 – Attribution of jurisdiction
